January 2016 Title Manual Update

The latest update to the Motor Vehicle Title Manual (attached) is now available via Registration and Title System workstations and at www.txdmv.gov.

We welcome your feedback and encourage you to email any comments or suggestions to VTR_Title_Reg-Manual-Update@txdmv.gov (please note the underscores between VTR and Title and Title and Reg).

Updates for this release are marked with red change bars in the text.

The following are brief summaries of the chapters updated in the January 2016 revision:

Chapter 2 – Administration and Transaction Handling Procedures
Section 2.3, “Rejected Title Transactions/Rejection Requests,” was updated to provide guidance to county tax assessor-collectors’ offices on correcting rejected transactions processed through webDEALER.

Chapter 6 – Application and Issuance of Motor Vehicle Title
Section 6.16, “Electronic Titling System,” was updated with additional information on how to obtain a paper copy for an eTitle with a lien and an eTitle without a lien processed through webDEALER.   

Chapter 8 – Refusal/Denial of Title
Section 8.4, “Bonded Title,” was updated to provide clarification that an Application for Assigned or Reassigned Number, Form VTR-68-A, is an acceptable document to verify the vehicle identification number for bonded titles.
 
Chapter 9 – Transfer of Ownership
Section 9.4, “Dealer Assignments,” was updated to include information provided in RTB #011-15 on the use of the Reassignment of Title for a Motor Vehicle, Form VTR-41-A, when all reassignments on the Texas Certificate of Title have not been completed.

Chapter 11 – Signature – Authority to Sign
Section 11.3, “Powers of Attorney,” was updated to include information provided in RTB #010-15 reinforcing the proper use of the Power of Attorney for Transfer of Ownership to a Motor Vehicle, Form VTR-271-A.

Section 11.4, “Secure Power of Attorney,” was updated to provide clarifying instructions on completing Parts A, B, and C of the Power of Attorney for Transfer of Ownership to a Motor Vehicle, Form VTR-271-A.

Section 11.5, “Limited Power of Attorney for Eligible Motor Vehicle Transactions,” was added to provide guidance on acceptable use of the Limited Power of Attorney for Eligible Motor Vehicle Transactions, Form VTR-271.

Chapter 16 – Operation of Law
Section 16.5, “Trusts,” was updated to provide additional guidance regarding business entities operating as trusts. Business entities operating as trusts are not required to provide an Affidavit of Trust or a Statement of Fact for a Trust when transferring a vehicle in or out of the business entity’s name.

Chapter 23 – Foreclosure of Miscellaneous Liens
Sections 23.3, “Storage Lien,” and 23.4, “Licensed Vehicle Storage Facility Lien,” were updated for consistency with their respective foreclosure forms and as a result of a revision to the Application for Authority to Dispose of an Abandoned Nuisance Vehicle to Demolisher, Form VTR-71-6, on acceptable proof of law enforcement notification.
