July 2014 Title Manual Update

The latest update to the Motor Vehicle Title Manual (attached) is now available via RTS workstations and at www.txdmv.gov.

We welcome your feedback and encourage you to email your comments and suggestions to VTR_Title_Reg-Manual-Update@txdmv.gov (please note the underscore between VTR and Title and another underscore between Title and Reg).

Updates for this release are marked with red change bars in the text. 

The following are brief summaries of the chapters updated in the July 2014 revision.

Chapter 6 – Application and Issuance of Motor Vehicle Titles
Section 6.3 “Personal Identification Information for Obtaining Title” was updated as a result of RTB #013-14.  The update adds that an employee’s or authorized agent’s employee ID is acceptable to establish authority to sign on behalf of an entity.  Additionally, any proof of signature authority may be either an original or photocopy.  A GDN holder is exempt from having to submit authority to sign on behalf of an entity to the county tax assessor-collector, but must retain a copy of proof in the purchase and sales records.

Chapter 16 – Operation of Law
Section 16.4 “Estates of Decedents” was updated to reflect the correct location of statute.  Provisions previously in the Probate Code were moved to the Estates Code.  There is no content change in this section.

Chapter 24 – Certified Copies
Section 24.5 “Owner Verification Procedures/Acceptable Identification” was updated to reflect changes to Texas Administrative Rule 43 TAC §217.3 (e).  The definition of “current” identification was extended from six (6) months to twelve (12) months to ensure consistency with initial title application.  The update adds that an employee’s or authorized agent’s employee ID is acceptable to establish authority to sign on behalf of an entity.  Additionally, any proof of signature authority may be either an original or photocopy.

Chapter 25 – Motor Vehicle Dealers
This chapter was renumbered from Chapter 29 as a result of the elimination of Chapters 25 through 28.  The content of these chapters is now located in the TxDMV Assembled and Rebuilt Vehicle Manual and TxDMV Salvage/Non-repairable Motor Vehicle Manual.  There is no content change in this chapter.

Chapter 26 – Miscellaneous
This chapter was renumbered from Chapter 30 as a result of the elimination of Chapters 25 through 28.  The content of these chapters is now located in the TxDMV Assembled and Rebuilt Vehicle Manual and TxDMV Salvage/Non-repairable Motor Vehicle Manual.  There is no content change in this chapter.
