The following are brief summaries of the chapters updated in the October 2014 revision.
Chapter 2 – Administration and Transaction Handling Procedures
Chapter 2 was renamed from “Administration” to “Administration and Transaction Handling Procedures” to more clearly identify the content of the chapter.
Section 2.3 “Rejected Title Transactions/Rejected Requests” was merged with content previously located in Section 6.12 “Rejected Title Transactions.” Additionally, this section was updated to reflect recent changes in handling procedures as a result of RTB #004-14 (Title Package Processing), which in part eliminated the “Rejection” Specially Marked Envelope and associated procedures.
Section 2.4 “Rejection Requests After Title Issuance (Revocation)” was added as a result of RTB #016-14 (Automatic Title Issuance) to document procedures for handling title corrections after a title has been issued and the transaction paperwork is still in a county tax assessor-collector’s office.
Section 2.5 “Lost Title Transaction” was relocated from Section 6.16 “Lost Title Report or Transaction.” Additionally, this section was updated as a result of RTB #016-14 (Automatic Title Issuance) to reflect the elimination of Title Package Reports (TPRs) being sent to the department.
Section 2.6 “Title Transaction Documents – Assembly Procedures” was updated as a result of the statewide implementation of the direct mailing program as outlined in RTB #020-14 (Title Transaction Assembly Procedures and Direct Mailing), which revised assembly and mailing procedures.
Section 2.7 “Specially Marked Envelopes – Assembly Procedures” was previously located in Section 2.4 “Title Transaction Assembly Procedures.” The content in this section was separated as a result of the statewide implementation of the direct mailing program outlined in RTB #020-14 (Title Transaction Assembly Procedures and Direct Mailing), which revised assembly and mailing procedures.
Chapter 4 – Definitions
Section 4.2 “Remarks/Brands” was relocated from Chapter 6. There was no substantial content change to this section.
Chapter 6 – Application and Issuance of Motor Vehicle Titles
Section 6.3 “Personal Identification Information for Obtaining Title” was updated as a result of RTB #017-14 (Capture of Federal Employer Identification Number/Employer Identification Number) by adding a subsection regarding use of the FEIN/EIN for a title transaction.
Section 6.8 “Issuance of Title” was updated as a result of RTB #016-14 (Automatic Title Issuance) by adding a subsection regarding the automatic issuance of a title seven calendar days after processing unless there is a hard stop on the record.
Additionally, sections within this chapter were relocated or merged with other chapters within the manual as outlined above for the revisions in Chapter 2 and Chapter 4.
Chapter 17 – Rights of Survivorship
Section 17.14 “Unable to Determine Survivor” was added to provide guidance on situations involving titles that do not have the printed name of the survivor, or when film is no longer available to assist in identifying the named survivor.
Chapter 23 – Foreclosure of Miscellaneous Liens
Section 23.5 “Self-service Storage Facility Lien” was revised for clarity and consistency with statute. There was no change to policy or procedure regarding these liens.
Section 23.7 “Statutory Foreclosure Procedures Charts” was updated as a result of the revisions to Section 23.5 as detailed above.
