2018 Unified Carrier Registration (UCR) Delayed Until Further Notice

The Unified Carrier Registration (UCR) Board of Directors has delayed until further notice the start of 2018 UCR registration. The delay will stay in place until the Federal Motor Carrier Safety Administration completes rule making to establish 2018 fees.

October 2017 Motor Vehicle Registration Manual Update

The latest update to the Motor Vehicle Registration Manual (attached) is now available via Registration and Title System (RTS) workstations and at www.txdmv.gov.

Updates for this release are marked with red change bars in the text.

The majority of the manual revisions include changes from the 85th Legislative Session. The following are brief summaries of the chapters updated in the October 2017 revision.

Chapter 3 – Disabled Persons
Section 3.19, “Seizure and Revocation of Placards,” was updated due to House Bill (HB) 1790, which allows for an applicant whose placard was seized by law enforcement to apply for a new placard. This change was also explained in Registration and Title Bulletin (RTB) #013-17.

Chapter 8 – Additional and Voluntary Fees
Section 8.1, “State’s Portion of Inspection Fee,” was updated due to HB 1793, which requires vehicles with a gross vehicle weight of more than 26,000 lbs. domiciled out of state to be assessed the state’s portion of the commercial inspection fee. Note: Section 22.8, “Out-of-State Motorists,” was updated with the same changes.

Two new sections, Section 8.14, “Voluntary Donation to Evidence Testing Grant Program,” and Section 8.15, “Voluntary Donation to Ending Homelessness Fund,” were added due to HB 4102, which provides for two new voluntary contribution opportunities at the time of initial registration or renewal.

Chapter 9 – Registration Fees
Section 9.3, “Trailer or Semitrailer Fees,” was updated due to Senate Bill (SB) 2076, which changed the dimensions of a travel trailer to be less than eight feet, six inches in width or less than 45 feet in length. These changes were also provided in RTB #007-17.

Chapter 12 – Off-Highway, Log Loader, Forestry, and Miscellaneous
Section 12.1, “All-Terrain Vehicles (ATV),” and Section 12.2, “Recreational Off-Highway Vehicles (ROV),” were updated due to HB 1956 and HB 920, which made changes to the operation of these vehicles on public roads based on the vehicle’s operator and use.

A new section, Section 12.5, “Package Delivery Vehicles,” was added due to HB 561, which creates the issuance of new Package Delivery License Plates. These plates may be issued to ATVs, golf carts, neighborhood electric vehicles, ROVs, and utility vehicles operated by a motor carrier for the purpose of picking up and delivering mail, parcels, and packages. These plates are scheduled to be available for issuance with the RTS release 9.0.

Chapter 14 – Application for Registration and Certain Permits
Section 14.4, “Initial Registration,” was updated to clarify the residency requirements for an owner of a farm or ranch located in a county other than their county of residence and where the vehicles used at the ranch may be registered.

Section 14.6, “Owner Designation Registration Period,” was removed due to HB 2075, which repealed Transportation Code, Section 502.1585. This section allowed an owner to designate the registration period for more than one vehicle they owned. The change was also provided in RTB #011-17.

Section 14.8, “Registration Receipt,” was updated due to HB 2075, which allows for a registration receipt issued for a renewal processed online to serve as proof of registration for 31 days from the date of renewal.

Section 14.11, “Refusal to Register Vehicles (Scofflaws),” was updated due to SB 1913, which prevents a county tax assessor-collector from denying registration to an individual that has been found indigent by the court.
 
Chapter 19 – Military Specialty License Plates
Section 19.2, “General Application Procedures,” was updated due to HB 377 and SB 441, which allow a surviving spouse of a person who would be eligible for a military specialty license plate or Disabled Veteran License Plate to register their vehicle with the military plate or a Surviving Spouse of a Disabled Veteran plate if they remain unmarried.

Chapter 20 – Restricted Distribution Specialty License Plates
A new section, Section 20.4, “Star of Texas License Plates,” was added due to HB 979, which creates the issuance of a new license plate for recipients of the Star of Texas Award issued by the Governor’s Office.

Chapter 21 – Miscellaneous Specialty License Plates
Section 21.1, “Antique and Former Military,” was updated and explained in RTB #005-17. These changes allow a former military vehicle not designated as “Off-Highway Use Only” to be used for regular transportation. All requirements for registration would apply, including safety and emissions inspections and insurance.

Chapter 22 – Inspection Verification
Section 22.12, “Additional Inspection Information,” was updated due to SB 1001, which changed the gross weight for trailers required to be inspected from 4,500 lbs. or less to 7,500 lbs. or less. This bill also created a new fee to be assessed for trailers with a gross weight of 4,501 lbs. to 7,500 lbs. that supports the Texas Mobility Fund and Clean Air Account. These changes were also provided in RTB #012-17.

A majority of the manual revisions include changes from the 85th Legislative Session.  The following are brief summaries of the chapters updated in the October 2017 revision.

Chapter 5 – Certificate of Title Requirements
Section 5.5, “Trailers and Semitrailers,” was updated as a result of Senate Bill (SB) 2076 and as detailed in Registration and Title Bulletin (RTB) #008-17. SB 2076 made changes to allow all trailers and semitrailers with a gross vehicle weight of 4,000 pounds or less and all farm trailers and farm semitrailers with a gross weight of 34,000 pounds or less to be permissively titled. Additionally, all trailers and semitrailers previously titled are required to remain titled.

Chapter 8 – Refusal/Denial of Title
Section 8.3, “Bonded Title,” was updated to include information provided in RTB #010-17, which requires an applicant to provide a completed Law Enforcement Identification Number Inspection (Form VTR-68-A) if there is no Texas record for the motor vehicle.  Additionally, this section was updated to include the requirements from Texas Administrative Code, Rule 217.9, which mandates appraisals must be dated and submitted to the department within 30 days of the appraisal being completed.

Chapter 13 – Vehicle Identification Numbers
This chapter was revised and reorganized in an effort to provide clarification. It has also been updated to include changes resulting from SB 2076.

Chapter 14 – Vehicle Types
Section 14.6, “Farm Trailer/Farm Semitrailer,” was updated as a result of SB 2076, which allows farm trailers and farm semitrailers with a gross vehicle weight of not more than 34,000 pounds to be eligible for optional titling and requires them to continue to be titled if previously titled.

Section 14.7, “House, Camper, and Travel Trailers,” was updated as a result of SB 2076 to reflect the increase in width from eight (8) feet to eight (8) feet, six (6) inches and the increase in length from forty (40) feet to forty-five (45) feet.

Chapter 22 – Abandoned Vehicles
This chapter was revised and reorganized in an effort to provide further clarification.

Chapter 23 – Foreclosure of Miscellaneous Liens
This chapter was updated to reflect changes resulting from the passing of House Bill 3131, which provided alternative methods for statutory lienholders to dispose of unclaimed, abandoned motor vehicles.

Only one week remains before the October 31 submission deadline. The PQRP application, Form 2017-001, can be found on page 40 of the program guide and located at www.txdmv.gov/county-recognition.

The Texas Department of Motor Vehicles (TxDMV) has published in the Texas Register proposed changes to the Texas Administrative Code, which affect Chapter 219, §§219.34, 219.35, and 219.36.  These proposed changes are posted for public comment until 5:00 p.m. on November 20, 2017.  The proposed language is attached and it is also available on the Office of the Secretary of State’s website at http://www.sos.state.tx.us/texreg/pdf/currview/index.shtml.

Texans urged “Don’t let the future owner of your vehicle be the next victim of Hurricane Harvey.”

AUSTIN – With an estimated 500,000 to one million cars and trucks ruined in recent floods from Hurricane Harvey, the Texas Department of Motor Vehicles (TxDMV) is reminding Texans whose vehicles were flood damaged of their duty to get their titles branded.

Texas law requires any vehicle damaged to the extent that it meets the definition of salvage or nonrepairable to be issued a salvage title or nonrepairable title, respectively, prior to any future title transfers.  If the vehicle is damaged due to a flood, the salvage or nonrepairable title will be marked with a “Flood Damage” notation, also known as a brand.

While many of these vehicles will go through insurance companies and get marked as flood damaged, there may be tens of thousands of vehicles that are uninsured or covered by liability only insurance.  TxDMV wants to ensure owners of these vehicles are aware of Texas law.

Texans with comprehensive insurance coverage should contact their insurance providers who will facilitate the title process and notify TxDMV of the flood-damaged vehicle.

Texans who have liability only insurance or have no insurance at all are still required to determine if their vehicle is salvage or nonrepairable.

TxDMV offers these steps to those vehicle owners:

  • Get the vehicle inspected by any insurance adjuster to determine the amount of damage.
  • Determine the value of the vehicle from a national reference guide.
  • If the amount of damage exceeds the value of the vehicle in the national reference guide, you must apply for a salvage or nonrepairable vehicle title.

You must obtain a salvage or nonrepairable title if the vehicle is damaged to that extent before you transfer the vehicle.  The only exception to this requirement is if the vehicle is being transferred to an insurance company paying a claim, a licensed salvage dealer, used automotive parts recycler, or metal recycler.  Owners who fail to comply with this requirement are subject to criminal penalty.  In addition, it is a violation of state law to operate, register, or permit the operation of a salvage or nonrepairable vehicle on a public highway.  Criminals looking for an opportunity to make a quick dollar will be on the lookout for flood-damaged vehicles they can buy cheaply and sell to innocent victims.

“Too many Texans already get taken advantage of by people selling flooded, salvaged, and rebuilt vehicles as though they were in perfect condition,” said TxDMV Executive Director Whitney Brewster.  “Don’t let the future owner of your damaged vehicle be the next victim of Hurricane Harvey.”

Information on applying for a salvage or nonrepairable title can be found on TxDMV’s Hurricane Harvey Emergency Information webpage at www.TxDMV.gov/Harvey.  The process is relatively simple, usually involving only the current vehicle title, completing a one-page form, and payment of the $8 application fee. TxDMV also provides information about how to protect yourself from unknowingly purchasing a flood-damaged vehicle by doing a Title Check before you buy.

“Owners of these vehicles must know of their responsibility to obtain a salvage or nonrepairable title before selling the vehicle to someone else,” Brewster said. “This ensures future purchasers are aware of the vehicle’s prior, flood-damaged condition.”

“Remember,” she added, “When title fraud happens, innocent people are hurt.”

On October 21, 2017, Data Center Services (DCS) will be performing system maintenance that may result in brief interruptions in network connectivity to the eTAG system. The duration of the maintenance is scheduled for up to 12 hours beginning at 7:00 PM CST (10/21/2017) and lasting until 7:00 AM on Sunday, October 22, 2017 AM CST. 

As a reminder, if you are unable to print buyer’s tags, you should use your pre-printed Internet Down buyer’s tags.   As you know, every dealer is now allowed a minimum of 30 Internet Down tags.  If you have less than 30 printed, print your full allocation now so you are prepared when the eTags system is unavailable.  Please remember that after using an Internet Down tag, you must enter the information for that tag into eTags as soon as the system is accessible.  Doing this, will ensure you always have the full allocation of unused Internet Down tags available when you need them. Also remember that unused Internet Down tags are valid for one year from the date they are printed.

Extension of Temporary Waiver to Renew Registration or Register a Vehicle

Governor Greg Abbott granted residents of counties affected by Hurricane Harvey a temporary extension to renew their vehicle registration. This was done by proclamation on August 28, 2017. The Governor signed a proclamation yesterday extending the original proclamation another 30 days. The new waiver is effective until November 15, 2017.

The temporary waiver is restricted to vehicle owners from the counties in the proclamation referenced above. The most recent proclamation includes an updated list of counties afforded the temporary extension and is attached for your convenience.

Guidance on the National Motor Vehicle Title Information System (NMVTIS) HOLD Remarks in the Registration and Title System (RTS)

The American Association of Motor Vehicle Administrators (AAMVA) and the United States Department of Justice (USDOJ) are the organizations responsible for oversight and administration of the National Motor Vehicle Title Information System (NMVTIS). AAMVA and USDOJ have reported an increase in Texas title applicants contacting their offices as a result of NMVTIS HOLDs on Texas title records. Specifically, Texas title applicants have reported county tax assessor-collector’s offices are informing them their record has an NMVTIS HOLD and not providing these applicants with information necessary to address the error that caused the NMVTIS HOLD. These applicants are left with the impression a federal system is preventing their Texas title from being issued, and this is not correct. In actuality, the Texas Department of Motor Vehicles (TxDMV) has placed the hold on the record as a result of information obtained from NMVTIS, such as missing brands and superseded titles.

We would like to remind you NMVTIS is a system the TxDMV queries for applicable title transactions. Based on the results of the inquiry and the information entered by a county tax assessor-collector’s office into the Registration and Title System (RTS), errors are flagged with an NMVTIS HOLD by the RTS, and an error report is distributed to the processing county tax assessor-collector’s office. NMVTIS itself is not responsible for flagging the RTS records with an NMVTIS HOLD.

All NMVTIS HOLDs require correction by a county tax assessor-collector’s office through the RTS or special handling by the TxDMV. AAMVA and the USDOJ do not have the ability to resolve Texas NMVTIS HOLD issues.

If a Texas title applicant contacts your office regarding their record and the RTS record contains an NMVTIS HOLD, please provide the applicant the necessary information to resolve the issue. If the transaction was not originally processed by your county, please direct the applicant to the appropriate county for correction. If you are unable to determine the reason for the NMVTIS HOLD, please utilize Cognos to search the “NMVTIS Inquiry Report” for the specific transaction. If you are unable to determine what actions are required to correct the NMVTIS HOLD error, please utilize the NMVTIS Guide, or contact your local TxDMV Regional Service Center.

Revision of Registration Related Forms

The Vehicle Titles and Registration Division has undertaken an initiative to review, revise, consolidate, and/or eliminate more than 50 registration-related forms. These updated forms will be made available for your use over the coming months.

All forms revised due to new policies or procedures will be communicated through a Registration and Title Bulletin (RTB). Forms with aesthetic changes or other non-substantive changes will not be accompanied by an RTB since the intended use of the forms is not changing. We will issue a notification as each form becomes available.
