Miscellaneous Lien Foreclosure Charts

Please review and distribute as appropriate.

We have worked diligently over the last year to clarify and streamline the various lien foreclosure processes, including making revisions to Chapter 23 of the Texas Department of Motor Vehicles (TxDMV) Motor Vehicle Title Manual and revisions for each of the six foreclosure forms. We continue to work with industry stakeholders to streamline processes where possible and make clarifications as necessary.

As part of this process, we distributed Registration and Title Bulletins (RTBs) that included flow charts covering the process associated with the RTB. Immediately following the publication of those flow charts, we received positive feedback and requests to provide flow charts for all of the foreclosure processes.

Today, we are happy to be able to provide you with additional charts as requested. You will find a process flow chart for each of the six foreclosure processes attached to this communication. Please note that the mechanic’s lien foreclosure process has two flow charts as a result of legislative changes made during the 84th Legislative Session. This distribution of these flow charts does not constitute a change in any policy or procedure for the respective lien foreclosures.

These charts should provide you general guidance and assistance in processing these types of transactions. As with any job aid, there may be nuisances and variations that are not covered. While they will greatly assist with the majority of situations, there will be situations you may encounter that are not addressed. If this occurs, refer back to the title manual or contact your local TxDMV Regional Service Center.

Thank you,

Jeremiah Kuntz, Director
Vehicle Titles and Registration Division
Texas Department of Motor Vehicles
