October 2023 Motor Vehicle Title Manual Update

The latest update to the Motor Vehicle Title Manual (attached) is now available via Registration and Title System (RTS) workstations and at www.txdmv.gov.

Updates for this release are marked with red change bars in the text.

Chapter 2 – Administration and Transaction Handling Procedures
Section 2.7, “Specially Marked Envelopes – Assembly Procedures,” was updated to “Special Handling Procedures,” and includes information on scanning and emailing transactions to the department in lieu of physically mailing the transactions as outlined in Registration and Title Bulletin (RTB) #002-23.

Chapter 9 – Transfer of Ownership
Section 9.8, “Vehicle Transfer Notification,” was updated to specify vehicles sold September 1, 2023, or later require the seller to provide the buyer’s full name, address, and phone number for the department to mark the vehicle record and indicate the transfer.

Chapter 11 – Signature – Authority to Sign
Section 11.5, “Secure Power of Attorney,” was updated to include a note that states a Dealer’s Reassignment of Title for a Motor Vehicle (Form VTR-41-A) cannot be used when Part B of the Power of Attorney for Transfer of Ownership to a Motor Vehicle (Form VTR-271-A) still applies to the title transaction at the time of sale.

Chapter 16 – Operation of Law
Section 16.11, “Unclaimed Seized Vehicles,” was added to include the requirements for the disposition of a vehicle that was seized by law enforcement and left unclaimed by the owner as outlined in RTB #007-23.

Chapter 25 – Motor Vehicle Dealers
Section 25.4, “Dealer’s Reassignment of Title for a Motor Vehicle (Form VTR-41-A),” was updated to include a note that states the Form VTR-41-A cannot be used in lieu of Part B of the Form VTR-271-A, when Part B still applies to the title transaction at the time of sale.

October 2023 Motor Vehicle Registration Manual Update

The latest update to the Motor Vehicle Registration Manual (attached) is now available via Registration and Title System (RTS) workstations and at www.txdmv.gov.

Updates for this release are marked with red change bars in the text.

Various statutory references were updated throughout the manual as a result of the 88th legislative session.

Chapter 3 – Disabled Persons
Section 3.17, “Offenses,” was updated as a result of Senate Bill (SB) 904 by amending Transportation Code, Section 681.011, to specify a violation cannot be dismissed if the political subdivision has failed to mark the parking space that complies with Texas Law as long as it is in general compliance and has distinguishable markings that it is a designated accessible parking space for people who have disabilities.

Chapter 6 – Exempt License Plates
Section 6.3, “Regular Exempt License Plates,” was updated as a result of HB 3599 by amending Subchapter J, Chapter 502, which adds Section 502.458 to allow certain vehicles used by a “nonprofit food bank” to be exempt from the payment of registration fees under Chapter 502, Transportation Code.

Chapter 8 – Additional and Voluntary Fees
Section 8.5, “Electric Vehicle Fee,” was created as a result of Senate Bill 505 by adding Transportation Code, Section 502.360 which defines “electric vehicle” and requires fully electric cars and trucks with a gross vehicle weight of 10,000 lbs. or less to be assessed an annual $200 fee at time of initial registration or renewal. This update also includes the $400 fee for electric vehicles that are issued two years of registration to match a two-year inspection.

Chapter 10 – General Provisions
Section 10.11, “County Tax Assessor-Collector Operations,” was updated as a result of HB 3860 by amending Transportation Code, Chapter 520, Subchapter A, which adds Section 520.0072, to specify a county tax assessor-collector (TAC) may not be held responsible for an offense or damages occurring from the misuse of license plates or other fraudulent activity related to vehicle registration and titling by an individual or business entity that is deputized by the TAC who provides titling services.

Chapter 12 – Off-Highway, Log Loader, Forestry & Miscellaneous
Section 12.10, “Oil Well Servicing and Drilling Machinery,” was updated to remove the reference that the Application for Permit License Plates (Form VTR-67) is no longer submitted to VTR in Austin.

Chapter 17 – Transfer of Registration when Applying for Title
Section 17.6, “Transfer of Used Vehicle,” was updated as a result of HB 3288 to specify the Texas Motor Vehicle Transfer Notification (Form VTR-346) submitted must include the buyer’s full name, address, and telephone number.

Chapter 18 – Specialty and Personalized Plates
Section 18.2, “Personalized License Plates,” was updated due to the approval criteria change in Texas Administrative Code, Rule 217.27 for personalized license plates.

Chapter 20 – Restricted Distribution Specialty License Plates
Section 20.1, “Restricted License Plates Quick Reference,” chart was updated as a result of HB 627 to add that the surviving spouse of the person who was the posthumous recipient of the Star of Texas Award or the Peace Officer Purple Heart award is eligible to obtain the specific awarded license plate.

Section 20.1, “Restricted License Plates Quick Reference,” was also updated to include the following plates as a result of various bills passed during the 88th legislative session: 

  • Antarctica Service Medal license plate 
  • Industrial Firefighters license plate
  • Retired Peace Officer license plate
  • Classroom Teacher
  • Retired Classroom Teacher

Section 20.4, “Star of Texas License Plates,” was updated as a result of HB 627 to add that the surviving spouse of the person who was the posthumous recipient of the Star of Texas Award is eligible to obtain the license plate.

Section 20.5, “Occupational License Plates,” was updated to include the Retired Peace Officer and Antarctica Service Medal license plates.

Section 20.8, “Honorary Consuls,” was removed as TxDMV is no longer issuing the Honorary Consul license plate due to the U.S. Department of State not approving anyone to receive the plate.

Chapter 21 – Miscellaneous Specialty License Plates
Section 21.3, “Nonprofit Disaster Relief Organizations,” was updated as a result of HB 53 by amending Transportation Code, Sections 502.454(a), (b), and (f) to expand the list of authorized uses for a vehicle owned and operated by a nonprofit disaster relief organization and specifies the owner must certify that a vehicle is used exclusively for an authorized use.

Chapter 22 – Inspection Verification
Section 22.7, “Out-of-State Motorists,” was updated as a result of HB 198 to specify travel trailers more than 7,500 lbs. are not required to pass a state safety inspection as of September 1, 2023, but customers must self-certify that the travel trailer is in proper and safe condition. The new Application for Self-Certification of Travel Trailer More Than 7,500 lbs. (Form VTR-269) was created for this purpose to meet statutory guidelines.

Section 22.11, “Additional Inspection Information,” was updated as a result of HB 198 to specify that the owner must self-certify that the travel trailer is in proper and safe condition and removes the requirement that a travel trailer must require an inspection.

Initial Notification: Awareness of Licensing eMail Scam (10/06/2023 @ 11:30 AM)

Good morning,

The Texas Department of Motor Vehicles (TxDMV) recently received reports of email-fraud
related to unaffiliated parties posing as representatives of the department. These types of
emails request you to update your account or your account profile, requiring you to provide
personal information that can be used for malicious purposes.


Example of suspicious email:

Note the email is sent from info@txdmv.org, which is not a valid TxDMV address. The from
address for official TxDMV communications should be info@txdmv.gov, or a @txdmv.gov
valid address.


Examples of suspicious text:

    email scam 2

Note the info@txdmv.org again, which is not from TxDMV. Also note the “Validate Your
Profile”
link which is not valid, and is never requested by TxDMV.

Remember that legitimate emails from TxDMV will always be sent from an email address
that ends in @txdmv.gov. Also remember that TxDMV will never request your social
security number, date of birth, drivers license number, or passport number beyond your
initial online application. Malicious phishing emails that do not originate with the TxDMV
will typically request this type of information.

As a security measure we recommend you report any emails that appear to come from
the TxDMV which seem suspicious or unexpected, to the department at
Report-eFraud@txdmv.gov.


Remember the following tips to protect yourself:

    •  Be wary of any emails you were not expecting.  In cases where you can verify
        with the sender, do so by phone.

    •  Think before you click. Scammers depend on impulsive clickers.

    •  Be very cautious of those urgent deadlines – i.e. messages from the IRS,
        COVID-19, or your bank or credit card that demand an urgent response.

    •  Never enter your sensitive information in an untrusted site or pop-up window.

    •  Hover over a link with your mouse to determine if the link points to a legitimate
        address

    •  Do not reply to any suspicious emails!


Again, to report a suspicious motor vehicle related email or to verify if a TxDMV email is
legitimate, please forward the email to Report-eFraud@txdmv.gov.

Resolved: Texas by Texas Small Trailer Online Registration Renewals (10/06/2023 @ 11:20 AM)

Good morning,

The issue where Texas by Texas (TxT) online renewals were not charging customers the
Mobility/Clean Air fee for small trailers has now been resolved.

Finance has completed issuing fund adjustments for the affected customer transactions.

Counties can now re-run their Cognos Week-to-Date Fees Report and Funds
Remittance Report.  Once reviewed for accuracy, the Counties can remit funds in RTS.

Original Title Programming Enhancement to webSALVAGE

The Texas Department of Motor Vehicles (TxDMV) is excited to announce a programming enhancement to webSALVAGE that allows original title applications to be submitted electronically to county tax assessor-collectors. This enhancement was implemented with the Registration and Title System (RTS) Release 23.3 as a pilot, but is now available statewide. The original title enhancement is available to insurance companies and salvage pool operator users with access to webSALVAGE.

This enhancement allows electronic submission of original title applications for vehicles which an insurance company has paid a claim and that will be titled in the name of the insurance company. With the deployment of RTS Release 23.4, this enhancement also facilitates titling of unrecovered stolen vehicles for insurance companies. The attached webSALVAGE Original Title Addendum provides further processing details for insurance companies and salvage pool operators and will also be available on our website at www.TxDMV.gov. Transactions submitted through webSALVAGE will be processed in webDEALER by counties.

The TxDMV encourages you to begin using the original title application enhancement in webSALVAGE. If you are not setup to use webSALVAGE, you can easily get started by going to the webSALVAGE login page at https://webdealer.txdmv.gov/title/salvageLogin.do, selecting the “Create New User” button, and following the prompts. Once an account is created, additional users may follow the same steps. The administrator can then add the new users to their account and grant permissions. Additional information can be found in the addendum for salvage pool operators using their general distinguishing number in lieu of a salvage dealer license number.

Prior to submission of original title applications in webSALVAGE, you will need to work directly with the county you plan to submit these applications to for processing. The county will need to add your webSALVAGE account in webDEALER. This includes working with the county to establish a payment method, since payment for these applications will occur outside of webSALVAGE. Additional information can be found in the addendum.

Update to Renewal Submission Window for TxDMV Dealer Licenses

The Motor Vehicle Division of TxDMV has implemented a number of new processes to prevent fraudulent access to vehicle regulatory systems. These processes have resulted in an increase in application processing times, including renewal applications. The renewal submission window has been extended from 90 days to 180 days, meaning that dealers may now submit renewal applications up to 180 days in advance of their license expiration date. We strongly recommend the submission of renewal applications as early as possible to allow adequate time based on current processing timeframes.

The Texas by Texas (TxT) online renewals did not charge customers the Mobility/Clean
Air fee for small trailers who renewed between September 22nd through September 28th.

Customers that renewed registration for a small trailer online between September 22nd

Customers that renewed registration for a small trailer online between September 26th
through September 28th have been issued a refund and no sticker was printed. These

Collectors’ office. These customers also have the option to renew online.

Update @ 11:30 AM, 10/03/2023

Attention Counties:  For those customers who did not receive a refund –

Finance will begin issuing fund adjustments for the affected customer transactions.
Please do not remit funds for the fees until the fund adjustment is completed.
Finance estimates that the fund adjustments will take a few days to complete.

Updates will be provided as Finance works through the fund adjustment process.

RTS Connectivity Issues and transactions (10/02/2023 @ 5:20 PM)

Good afternoon,


TxDMV is aware of reported RTS connectivity issues and that some RTS users cannot log in.

Support staff has implemented a series of “unlocks” to address the RTS user log in issues.

If you are a RTS user that did not experience a login issue and/or did not experience any
lock out on your account, we still ask that you kindly log out of RTS, then log in again in order
to synchronize with RTS “unlock” commands so as to reestablish assured connectivity.

How to handle transactions after RTS unlocks

Scenario #1: You have completed the transaction but can’t print the transaction receipt.

        ○  Attempt to re-print the receipt
        ○  If unable to re-print, void the transaction and re-process the transaction
                    •  You will need to run a transaction reconciliation report to obtain the trans ID#,
                        in order to void, should you not have the trans ID# already

Scenario #2: You did not complete the transaction, and when you try to complete it,
                       the system tells you that the transaction is still i
n-process.

       ○  Access the pending transaction from your set asides
       ○  This should allow you to access the transaction to complete processing

Scenario #3: You did not complete the transaction, and it’s not in set aside.

       ○  Run the transaction reconciliation report to verify those transactions
            which are not completed
       ○  Redo transaction if the transaction was not completed.

The webDealer system performance issues have been resolved. The webDealer system was available
as of 11:00 PM, Friday, September 29, 2023.

Please remember that if you used an Internet Down tag, you must enter the information for that tag into 
webDealer as soon as the system is accessible. Doing this will ensure you always
have the full allocation of
unused Internet Down tags available when you need them. Also,
remember that unused Internet Down tags
are valid for one year from the date they are
printed.

The Texas by Texas (TxT) online renewals did not charge customers the Mobility/Clean
Air fee for small trailers who renewed between September 22nd through September 28th.

The webDEALER system is experiencing performance issues. Support staff are working to
troubleshoot the issue.   

An update will be provided as information becomes available.

As a reminder, if you are unable to print buyer’s tags, you should use your pre-printed Internet
Down tags. Every dealer is allowed a minimum of 30 Internet Down tags. Please remember that
after using an Internet Down tag, you must enter the information for that tag into webDEALER
as soon as the system is accessible.  Doing this, will ensure you always have the full allocation
of unused Internet Down tags available when you need them. Internet Down tags are valid for
one year from the date they are printed.
