TxDMV publishes rule proposals in the July 12, 2024, issue of the Texas Register

The Texas Department of Motor Vehicles (TxDMV) has proposed rules in the July 12, 2024, issue of the Texas Register. A summary of the proposed rules and the proposed language is available on TxDMV’s website at https://www.txdmv.gov/general-counsel/proposed-and-adopted-rules-2024.

The proposals are posted for public comment until 5:00 p.m. on August 12, 2024.

The proposals include:

  • revisions to 43 Texas Administrative Code (TAC) Chapter 215, concerning HB 718 and SB 224 legislative implementation and cleanup;
  • revisions to 43 TAC Chapter 217, concerning HB 718 and HB 3297 legislative implementation and cleanup;
  • revisions to 43 TAC §221.54, concerning HB 718 legislative implementation and cleanup;
  • revisions to 43 TAC §224.58, concerning HB 718 legislative implementation;
  • revisions to 43 TAC Chapter 209, concerning cleanup; and
  • new 43 TAC §215.124, concerning mobile warranty and recall repair by franchised dealers.

TxDMV Announces Direct-to-Dealer License Plate Distribution Model

The Texas Department of Motor Vehicles (TxDMV) continues to work closely with impacted stakeholders on the important process of implementing House Bill 718 from the last legislative session. The bill eliminates most paper temporary tags and requires vehicles to be issued metal plates at the time of sale. This is a significant operational change for both TxDMV and the Texas vehicle industry, and we appreciate your support as we work to implement the bill by the effective date of July 1, 2025.

At this time, TxDMV is excited to announce that we have selected a direct-to-dealer distribution model for license plate issuance as part of this implementation. Delivering license plates directly to dealers will streamline the process and ensure that plates are available to dealers as needed to support sales activity. The process is also intended to remove some of the logistical workload from tax assessor-collectors, allowing those offices to focus on their work processing title and registration transactions for dealers and individuals in an efficient and timely manner.

Here is how the new process will work:

  • The Texas Department of Criminal Justice (TDCJ) will continue producing license plates for TxDMV. Plates will be shipped from TDCJ to an external centralized distribution warehouse operated by a TxDMV contractor. This will mitigate the impact of correctional facility security incidents that can delay the production and shipment of plates. The department will work to maintain at least a six-month supply of plates at the contract distribution facility.
  • Department staff will use a new inventory management system to determine the number of plates to deliver to each dealer and to manage reorder requests from dealers and tax assessor collectors. The system will notify the distribution contractor when to ship plates to individual dealers and specific tax assessor-collectors. Upon receiving plates from the distributor, dealers will be required to keep them in secure locations as defined by department rules. The department is in the process of procuring this new system now.

This is just our first announcement of this important new process to serve the motor vehicle industry, and we will follow up with both counties and dealers with more detailed information as the contractors are procured and operational policies defined over the coming year. The department will also provide training on the new inventory management system to stakeholders once the system is configured and operational. Expect to hear more about those training opportunities in the spring of 2025.

Initial distribution of license plates, in preparation for the bill taking effect on July 1, 2025, is also expected to begin during the spring of 2025. The bill requires dealers to use webDEALER to process title applications. The department offers monthly webDEALER training opportunities for both county tax office staff and dealers. The training is available both in-person and virtually. Specific session dates can be found on the TxDMV website at www.txdmv.gov/calendar. We encourage dealers to complete webDEALER training as soon as possible to guarantee you are able to comply with the requirements of House Bill 718 in July 2025.

Initial Notification: webDealer System Maintenance (07/14/2024 @ 6:00 AM)

Good afternoon,

The Texas Department of Motor Vehicles (TxDMV) will be implementing system
maintenance for the webDealer System starting at 6:00 AM, Sunday (07/14/2024),
lasting up to 11:00 AM Sunday morning.

As a reminder, if you are unable to print buyer’s tags, you should use your pre-printed Internet Down tags. 
Every dealer is allowed a minimum of 30 Internet Down tags. Please remember that after using an Internet
Down tag, you must enter the information for that tag into webDealer as soon as the system is accessible. 
Doing this, will ensure you always have the full allocation of unused Internet Down tags available when you
need them. Internet Down tags are valid for one year from the date they are printed.

Note: A notification update will be published once the webDealer maintenance is completed.

The Texas Department of Motor Vehicles (TxDMV) will be implementing system
maintenance for the Registration and Title System (RTS) starting at 6:00 AM,
Sunday
(07/14/2024), lasting up to 11:00 AM Sunday morning.

During the deployment window, the RTS POS and associated systems will be
unavailable.
 

A notification will be published once the system maintenance is completed.

Texas Acting Governor Dan Patrick declared a disaster for 39 Texas counties in advance of Hurricane Beryl’s expected landfall this weekend. The Texas Department of Motor Vehicles has responded by temporarily suspending oversize/overweight permitting requirements for vehicles and loads associated with activities necessary to respond to the disaster. A copy of Acting Governor Patrick’s Waiver AND the TxDMV Waiver Notice signed by the TxDMV Executive Director must be carried in the vehicle.

Update: Temporary Suspension of Motor Carrier IRP Requirements for Disaster Relief

Acting Governor Dan Patrick has suspended certain vehicle registration requirements related to Apportioned Registration, also known as the International Registration Plan (IRP), and Temporary Permits for operators of commercial motor vehicles involved in Hurricane Beryl disaster relief in Texas. The suspension covers:

  • International Registration Plan (IRP) vehicle registration under Transportation Code, Section 502.091 and 43 TAC 217.56 to the extent the vehicle is not already registered under IRP, as long as the motor vehicle is registered in one of the 48 contiguous states of the United States; and
  • 72-/144-hour temporary registration permits under Transportation Code, Section 502.094 and 43 TAC 217.40(b)(3), as long as the vehicle is registered in another state of the United States or a state of the United Mexican States.

The suspension is needed to make it faster and easier for operators of commercial motor vehicles from Texas and other states to provide assistance to both Texas and Louisiana by temporarily waiving vehicle registration requirements to travel in and through the state of Texas. Although smaller passenger vehicles are granted free vehicle registration in Texas via registration reciprocity agreements with other states, commercial motor vehicles are not granted free vehicle registration under such agreements.

 

Examples of disaster assistance include, but are not limited to, vehicles engaged in the transport of relief workers, food, water, clothing, equipment, materials, fuel, shelter, and other supplies to the impacted areas, as well as vehicles used to restore utilities and to remove debris from the impacted areas.

 

The suspension only applies to the vehicle registration requirements for operators of commercial vehicles that are providing disaster assistance pursuant to the declarations referenced in Acting Governor Patrick’s proclamation. The suspension does not apply to any other requirement, including any safety requirements. Also, operators are responsible and liable for safely routing their vehicles and obtaining current restrictions and information concerning hazardous road conditions prior to movement.

Operators must keep a copy of Acting Governor Patrick’s proclamation AND a copy of the TxDMV Waiver Notice signed by the TxDMV Executive Director in the cab of the vehicle to provide to any peace officer upon request: documentation sufficient to identify the vehicle and/or load and to establish that the vehicle and/or load is being used exclusively for disaster relief efforts associated with Hurricane Beryl while operating under Acting Governor Patrick’s suspension.

Initial Notification: TexasSure Planned Maintenance (6/21/2024 @ 8:24 AM)

Good morning,

We have received notification from TexasSure for planned system maintenance scheduled
over this weekend. The maintenance is scheduled for Sunday, June 23, 2024, starting at
8:00 AM, lasting up to 4:00 PM on Sunday afternoon. 

TexasSure is used for insurance verification in renewal events. TexasSure will not be available
during the maintenance window.

Users will be required to enter/verify insurance information manually since TexasSure will be
unavailable for automatic insurance verification.

We will provide an update once the maintenance has been completed.

Texas.gov Payment Services is advising county users who administer the IVTRS and TXT program
to prepare for upcoming changes to sender e-mail addresses for automated reports from the
Transaction Processing Engine (TPE) Admin, the payment services reporting application.

At the county level, online VTR credit card activity is frequently reconciled with automated reports
delivered by e-mail to tax office staff directly from TPE Admin (Payment Engine NIC). County users
who rely on receiving automated reports, such as Batch Summary, Batch Detail, Net Revenue
Detail, Return Detail, and Refund Detail, are most likely to need to take action.

To ensure that any scheduled automated reports continue to be delivered without issue, Texas.gov
Payment Services encourages county users who receive automated reports from TPE Admin to
safelist the new sender e-mail addresses. Please reference the “Outlook-Safelist-How-To” attachment
on this bulletin which will provide step-by-step instructions on how to “safelist” an email.

Texas.Gov Payment Services

The updated sender email addresses are a consequence of the acquisition of Texas NIC, the current
Texas.gov Payment Services provider, by Tyler Technologies, Inc. Payment Services e-mail, including
automated reports for online VTR credit card transactions, will no longer be sent from egov.com

Initial Notification: Vehicle Specific Tags Issue (06/07/2024 @ 5:35PM)

Good afternoon,

The Texas Department of Motor Vehicles (TxDMV) is aware of an issue that prevented some dealers
from being able to create vehicle specific tags in the eTAG system following a recent eTAG update. 
Support Staff have since disabled the update and are working to implement a permanent solution. 

All dealers should be able to create vehicle specific tags at this time.

We apologize for the inconvenience and any impact on you or your customers.


As a reminder, if you are unable to print buyer’s tags, you should use your pre-printed Internet Down tags.
Every dealer is allowed a minimum of 30 Internet Down tags. Please remember that after using an Internet
Down tag, you must enter the information for that tag into webDEALER as soon as the system is accessible. 
Doing this, will ensure you always have the full allocation of unused Internet Down tags available when you
need them. Internet Down tags are valid for one year from the date they are printed.

Initial Notification: TexasSure Planned Maintenance (5/31/2024 @ 3:15 PM)

Good afternoon,

We have received notification from TexasSure for planned system maintenance scheduled
over this weekend.  The maintenance is scheduled for Sunday, June 2, 2024, starting at
8:00 AM, lasting up to 4:00 PM on Sunday afternoon. 

TexasSure is used for insurance verification in renewal events.  TexasSure will not be available
during the maintenance window.

Users will be required to enter/verify insurance information manually since TexasSure will be
unavailable for automatic insurance verification.

We will provide an update once the maintenance has been completed.
