TxDMV publishes 5 rule proposals in the August 30, 2019, issue of the Texas Register

The Texas Department of Motor Vehicles (TxDMV) has proposed rules to 43 TAC Ch. 217 in the August 30, 2019, issue of the Texas Register. The proposed language is available on TxDMV’s website at https://www.txdmv.gov/general-counsel/proposed-and-adopted-rules.

These proposals are posted for public comment until 5:00 p.m. on September 30, 2019. Please submit separate comments for each proposal.

 

The proposals address:

             

              (1) amendments to §217.2 and §217.45 concerning specialty license plates, symbols, tabs, and other devices; and §217.46 concerning commercial vehicle registration;

 

              (2) new §217.15 to establish a process for the TxDMV to issue a title to a government agency for a travel trailer used by the government agency to provide temporary housing in response to a natural disaster or other declared emergency;

 

              (3) new §217.16 concerning an application for title when dealer goes out of business, and amendments to §217.40 concerning special registrations;

 

              (4) amendments to §217.27, concerning extended registration of a trailer, semitrailer, or pole trailer; and

 

              (5) amendments to §217.41 concerning the location at which an application for a disabled parking placard may be made.

RTS 9.4.0 Fix for the Issuance of Temporary Permits

Please review and distribute as appropriate.

Registration and Title System (RTS) Release 9.4.0 added new hard stops for timed permits (72-Hour, 144-Hour, 30-Day, and One Trip) that required an authorization code to complete the transaction in RTS Point-of-Sale (POS). While the hard stops were intended to prevent fraudulent use of all timed permits for a vehicle not otherwise eligible for a permit, certain hard stops incorrectly required an authorization code to issue the permit.

A fix to the RTS POS was deployed after close of business on September 4, 2019, to correct this issue. The fix restored your ability to issue timed permits without obtaining an authorization code when the vehicle record reflects one of the following remarks:

  • Title Only and REGISTRATION INVALID
  • AWAITING NMVTIS VIN INQUIRY
  • TITLE HELD APPLICATIONS AWAITING RELEASE
  • TITLE HELD AWAITING DPS OK
  • TITLE REJECTED
  • TITLE REVOKED

TxDMV proposes rules relating to pre-licensing education and site visit criteria

The Texas Department of Motor Vehicles (TxDMV) has proposed amendments to §215.133, repeal of §215.102, and new §215.161 concerning site visit criteria, consignment GDN, and pre-licensing education for independent motor vehicle GDN holders. The proposed amendments are posted for public comment until 5:00 p.m. on September 23, 2019. Legislatively Required Training to Access the Registration and Title System (RTS)

Senate Bill 604, enacted by the 86th Legislature, adds Transportation Code, Section 520.023. The legislation requires the department to implement a training program on the department’s automated registration and titling system and identification of fraudulent activity related to vehicle registration and titling.

The Texas Department of Motor Vehicles’ (TxDMV) Board voted to post proposed rules on this training program for public comments during its August 8, 2019, board meeting. The training program will impact your offices in the form of an investment of time to allow your employees to complete this training. We encourage you to provide feedback on the proposed rules if you are concerned with the impact they may have and to begin taking proactive steps to maximize your time to complete training.

A detailed explanation of the proposed rule as well as the rule language can be found on the department’s website at https://www.txdmv.gov/proposed-and-adopted-rules under §217.75. You may provide public comment until 5:00 p.m. CST on September 23, 2019, by emailing rules@txdmv.gov.

Summary of the Rules – What is the impact?
The rules require all users of the Registration and Title System (RTS) to complete a minimum level of fraud training. Additional training will be required depending on the RTS security permissions granted to the individual users.

Programming to implement the training requirement will be included in RTS Release 9.5, which is currently scheduled for release December 2019. Existing users will have until August 31, 2020, to complete all required training associated with existing permissions. After RTS programming is implemented, new permissions cannot be enabled for any user until required training is completed.

If training is added or updated between December 14, 2019, and August 31, 2020, existing users will have until August 31, 2020, to complete the training. The department will provide notice of new or updated training in advance of the training’s release. The department will not release any new or revised training between June 1 and August 31, 2020. Starting September 1, 2020, any new or updated training associated with an existing RTS security permission must be completed within 90 days of the department’s notice that the training is available.

Training – What is the training, and how does it affect RTS security permissions?
Training will be completed through the department’s existing eLearning training system that has been available to you for many years. Each employee must complete the training with their assigned eLearning credentials. The department will be unable to give RTS users credit for training completed under a shared eLearning account. As a reminder, these training modules can be accessed from the TAC Hub by selecting “Go to TxDMV Learning Center” in the TAC Toolbox or directly at https://learningtxdmv.articulate-online.com/Login.aspx.

Training will be reported through RTS and subsequently verified by the department before new RTS security permissions can be added or existing RTS security permissions renewed when new or updated training is required. Security permissions will still be assigned and removed by county personnel; however, the department must verify all associated training for an applicable permission has been completed before the permission can be enabled. More information on the process of training verification through RTS will be provided in the coming months.

We have attached a preliminary document that maps all available RTS security permissions to the eLearning modules. Currently, there are 34 modules available that are associated with RTS security permissions. We are planning on developing an additional 17 modules that are shown in red font on the attached document. These new modules will be released in the coming months. Not every user will be required to complete all modules. However, every user will need to complete at least three fraud training modules and the “RTS Overview and

Security” module. From there, each security permission may be enabled by completing additional modules depending on the permissions. A user with all RTS security permissions would be required to take all modules.

eLearning modules typically range from 10 to 25 minutes in length. The module is considered complete if the user has achieved a score of at least 80% on the quiz at the end of the module. For contextual purposes:

  • A user processing only registration renewals may require up to 3 hours of training.
  • A user processing registration and title transactions may require up to 8 to 12 hours of training.
  • A supervisor or administrator-level user may require 24 hours or more of training.

The time it takes a user to complete the training will vary by user and the permissions the user has or will have assigned.

Preparation – What can you do now to maximize your time to complete the training?
You can take the following steps now to ensure you are prepared for the training requirement or have made progress towards completing training:

  1. Ensure each RTS user (including full-service deputies) in your county has an eLearning account. If not, complete the attached User Account Form. As a reminder, you receive one user account per workstation, with additional “no-cost” accounts calculated based on your total number of workstations. Please refer to Section 8.1, “eLearning Accounts” in the County Equipment Guide for information on the number of eLearning accounts available at the state’s expense.
  2. Ensure every RTS user in your county has completed the following four eLearning modules:
    • AAMVA FDR – Introduction to Fraud
    • AAMVA FDR – People and Actions
    • AAMVA FDR – Internal Fraud for Staff
    • R-108 – RTS Overview and Security
  3. Verify users have only the RTS security permissions they need to avoid users having to complete eLearning modules for unnecessary permissions.
  4. Ensure completion of, or begin having users complete, currently available eLearning modules associated with their assigned RTS security permissions. Users who have already achieved a score of at least 80% on the quiz at the end of a module will not be required to retake the module, unless the training is updated after December 2019.

TxDMV adopts rules relating to advisory committees

 

The Texas Department of Motor Vehicles (TxDMV) has adopted amendments to Ch. 206, Subchapter, E concerning advisory committees. The adopted language is attached and is also available on TxDMV’s website at https://www.txdmv.gov/general-counsel/proposed-and-adopted-rules.

 

The adoption became effective on August 29, 2019 and the changes are included in the Texas Administrative Code at http://texreg.sos.state.tx.us/public/readtac$ext.viewtac.

Communication to the Counties Regarding the Issuance of Temporary Permits

RTS Release 9.4.0, which was implemented September 1, 2019, added new hard stops for timed permits (72-Hour, 144-Hour, 30-Day, and One Trip) to the Registration and Title System (RTS) Point-of-Sale (POS). These hard stops have been added to prevent the fraudulent use of temporary tags on vehicles that are not eligible to be operated on public roads. Unfortunately, several of the new hard stops incorrectly require an authorization code to issue a timed permit when the vehicle record displays one of the following remarks:
     • Title Only and REGISTRATION INVALID
     • AWAITING NMVTIS VIN INQUIRY
     • TITLE APPLICATION AWAITING RELEASE
     • TITLE HELD AWAITING DPS OK
     • TITLE REJECTED
     • TITLE REVOKED.

We are implementing a hot fix in RTS POS to no longer require an authorization code to issue a timed permit when the vehicle record vehicle record displays one of the remarks listed above. Until this fix is implemented, an authorization code will be required to issue a timed permit for a vehicle record with those remarks.

RTS Release 9.4 correctly applies a hard stop for timed permits when the vehicle record reflects one of the remarks listed below. A vehicle with a record that reflects one of the remarks listed may not be operated on public roads. An authorization code should not be provided and a timed permit should not be issued for a vehicle with a record that reflects these remarks.

     • DOT PROOF REQUIRED

Good afternoon,

Over the weekend of August 31, 2019, the Texas Department of Motor Vehicles (TxDMV) will update the Registration and Titling System (RTS) with RTS Release 9.4.0. During the deployment of the RTS Release 9.4.0 you may experience intermittent connectivity issues to the following application:

Starting at 6:00 PM Saturday (08/31/2019) through 10:00 AM CST Sunday (09/01/2019):

  • webDEALER/eTAG
  • eLicensing

As a reminder, if you are unable to print buyer’s tags, you should use your pre-printed Internet Down buyer’s tags.  As you know, every dealer is now allowed a minimum of 30 Internet Down tags. If you have less than 30 printed, print your full allocation now so you are prepared when the eTags system is unavailable.  Please remember that after using an Internet Down tag, you must enter the information for that tag into eTags as soon as the system is accessible.  Doing this, will ensure you always have the full allocation of unused Internet Down tags available when you need them. Also remember that unused Internet Down tags are valid for one year from the date they are printed.

 

Note: A reply to all will be sent when the maintenance is complete. Please contact the TxDMV Customer Service department if you experience system issues after the maintenance has been completed.

Legislative Changes

The following are the changes in RTS 9.4.0 mandated by the 86th Legislative Session:

TxDMV Holiday Hours – Labor Day 2019

In observance of Labor Day, all Texas Department of Motor Vehicles (TxDMV) offices will be closed on Monday, Sept. 2. Note to motor carriers: The Motor Carrier Oversize/Overweight Permits Section will also be closed on Saturday, Aug. 31. 

Vehicle title and registration services: Most vehicle title and registration services are provided by your county tax office. County tax office hours may vary. Registration renewal is available online 24/7 at www.TxDMV.gov.

Oversize/Overweight permits: Motor Carrier Oversize/Overweight permits can be ordered online 24/7 through the Texas Permitting and Routing Optimization System (TxPROS) at www.TxDMV.gov.

Upcoming Changes for Size and Weight Permits

Intermodal Shipping Container Port Permits: After Sept. 1, 2019, the “Port of Bayport” will be available for customers renewing or ordering new Intermodal Shipping Container Port Permits.

Legislative Changes

The 86th Texas Legislature passed new laws that impact the movement of oversize/overweight vehicles and loads. These changes are effective Sept. 1, 2019.

Company Name on Permit: The company/individual’s name listed on an oversize/overweight permit must match the name of the company/individual operating the permitted vehicle. It will be a Class C misdemeanor if the two names do not match.

This does not apply to a tow truck that is moving a disabled, abandoned, or accident-damaged vehicle/vehicle combination to the nearest terminal, storage facility, or place of repair. It also does not apply to any active permits issued before Sept. 1, 2019.

Escort Flaggers: New requirements will be in effect for escort flaggers. An escort flagger is anyone who directs or controls the flow of traffic as required by an oversize/overweight permit issued by TxDMV.

Beginning Sept. 1, 2019, escort flaggers must successfully complete a training program in traffic direction. The program must meet the basic peace officer course curriculum requirements for traffic direction that have been established by the Texas Commission on Law Enforcement (TCOLE). TCOLE will offer training courses for escort flaggers after Sept. 1, 2019. Contact TCOLE for more information, https://www.tcole.texas.gov/.

In addition, escort flag vehicle will be allowed alternating or flashing amber and blue lights beginning on Sept. 1, 2019.

Please Note: training requirements do not apply to escort vehicle operators or flaggers who are not directing traffic.

Annual Timber Permit: An Annual Timber Permit may be used to transport equipment used to load timber on to a vehicle. The size and weight limits of the permit remain the same.

As a reminder, if you are unable to print buyer’s tags, you should use your pre-printed Internet Down buyer’s tags.  As you know, every dealer is now allowed a minimum of 30 Internet Down tags. If you have less than 30 printed, print your full allocation now so you are prepared when the eTags system is unavailable.  Please remember that after using an Internet Down tag, you must enter the information for that tag into eTags as soon as the system is accessible.  Doing this, will ensure you always have the full allocation of unused Internet Down tags available when you need them. Also remember that unused Internet Down tags are valid for one year from the date they are printed.

 

Note: A reply to all will be sent when the maintenance is complete. Please contact the TxDMV Customer Service department if you experience system issues after the maintenance has been completed.

Initial Notification: Scheduled Maintenance (08/25/2019 @ 7:00 AM CST)

TexasSure, the system TxDMV uses for insurance verification, is scheduled to perform system maintenance on Sunday, August 25, 2019. The duration of the maintenance is scheduled for up to two hours from 7 AM to 9 AM CST.

 

Systems Impacted: The systems below will be unable to access vehicle insurance verification during the maintenance window. Users will need to manually verify their insurance during this timeframe:

  • IVTRS
  • webSUB

Initial Notification: webDEALER Reported Issues (08/23/2019 @ 3:07 PM CST)

Good afternoon,

 

Over the weekend of August 16, 2019, the Texas Department of Motor Vehicles (TxDMV) released webDEALER eTITLES and the Registration and Titling System (RTS) Release 9.3.0. The following issues have been reported with webDEALER:

 

webDEALER Receipts Missing Registration Sticker Information

When webDEALER title application receipts are batch printed, the registration sticker information is not printing correctly on one of the receipts.

  • This is a random occurrence, but impacts counties printing receipts for dealers without inventory and dealer deputies printing their own receipts
  • Users may print receipts individually since it does not appear individually printed title application receipts are impacted
  • If you continue to batch print receipts, ensure all registration stickers print correctly
  • Any receipt with an incorrectly printed registration sticker will need to be processed as a no fee replacement through a county tax office
  • The department is researching the cause of this and will provide additional information as it becomes available

Heavy Vehicle Use Tax Verified Printing Incorrectly on Receipts

“Heavy Vehicle Use Tax Verified” was incorrectly printing on webDEALER receipts and updating the vehicle record for vehicles not subject to the heavy vehicle use tax.

  • This has been resolved, but the department is in the process of identifying impacted vehicle records
  • Once the records are identified, the department will programmatically remove the incorrectly applied remark. This will not require action on your part

Diesel Indicator and Sales Tax Emission Fee

The diesel checkbox was not enabled in webDEALER, preventing dealers from selecting it. As a result, the diesel indicator was not being recorded on the transaction, and the sales tax emissions fee was not charged.

  • A fix was implemented last night, so dealers are now able to select the diesel checkbox
  • The department determined certain counties were impacted, which have been provided in the attachment
  • Impacted counties should not approve any webDEALER transaction for a vehicle with a gross weight over 14,000 pounds
  • The department will contact impacted counties to provide instructions on how to resolve the transactions pending approval and the transactions that have already been approved
