RTB #004-21 Requirements and Availability of the Disabled Veteran (DV) License Plate with the International Symbol of Access (ISA)

Registration and Title Bulletin (RTB) #004-21 provides guidance on the updated eligibility requirements and availability of the new disabled veteran license plates that include the International Symbol of Access and changes to parking privileges for disabled veterans as a result of Senate Bill (SB) 792, enacted by the 87th Legislature.

To support this change, revisions were made to the Application for Disabled Veteran License Plates and/or Parking Placards (Form VTR-615). RTB #004-21 and the revised form are attached.

2022 Calendar and Application Manager Dates

Please review and distribute as appropriate.

Attached are two files providing both a calendar and a table listing format of the Gregorian and Application Manager (AM) dates for calendar year 2022.

The AM date is part of the transaction identification number that prints on receipts and certain reports.  This information is helpful when reviewing reports that list transactions only by their AM dates and not Gregorian dates.  The following example denotes the position of the AM date:

Transaction number: 01534944590163051

The underlined and bolded five-digit number is the AM date.  It occupies the position of digits 7 through 11 in a transaction number.  The number can be found on the Gregorian calendar under the day of the particular month.  For example, the number 44590 is listed under “January” and under “31.”  Therefore, the Gregorian date for this transaction would be January 31, 2022.

Central Freight Lines Update

As a follow up to the communication on December 13, Central Freight Lines, who provides freight delivery services for the Texas Department of Motor Vehicles (TxDMV) plate and supply delivery from Huntsville, closed their business. Central Freight announced it would stop picking up freight on December 13 and would deliver the freight already in its system by December 20, ceasing all operations afterward.

On December 15, our logistics company identified a new freight carrier, Southeastern Freight. Any outstanding orders impacted by Central Freight’s closure were collected by Southeastern Freight on Wednesday, December 15. It should be noted that Southeastern Freight may not offer the same customer-service options (i.e., inside delivery, etc.) in all markets. Inside delivery will be identified in advance on the bill of lading prior to shipment. If inside delivery is required and not denoted on the bill, please contact your Regional Service Center, so we can work with the freight company to cover the additional charges for the service.

Please be aware this situation continues to develop and additional changes to carriers may be necessary. We will continue to monitor the situation to ensure freight services return to normal, and all pending orders are successfully delivered.

Central Freight Lines Update

House Bill (HB) 2152: Online Renewal Up to 12 Months Past Expiration

Registration and Title System (RTS) Release 11.0, scheduled to deploy this weekend, will allow online registration renewal up to 12 months past expiration using the Internet Vehicle Title and Registration Service (IVTRS) as a result of HB 2152, enacted by the 87th Legislature. Currently, motorists who renew online via IVTRS may only renew up to nine months late if they have not received a law enforcement citation for the expired registration. With this enhancement, motorists will be able to renew up to 12 months late if they have not received a citation.

Additionally, anyone renewing between 10 and 12 months late will be given the option to renew for the current, past-due, registration year and the subsequent registration year. The month of expiration will not change for motorists using this option. Registration and local county fees will be doubled when registration is renewed for both years; however, only one Processing and Handling Fee will be charged.

Motorists renewing online must have a current, passing vehicle inspection in the state inspection database or certify that the vehicle is located out of state. If the vehicle is out of state, a VERIFY INSPECTION remark will be placed on the motor vehicle record for law enforcement use.

IVTRS may be accessed at www.Texas.gov or via the TxDMV.gov website. Although the Texas by Texas (TxT) system is active for user account set up and registration renewal, the 12-month extension will not be available in TxT until such time that programming can be completed.

Please refer to RTS County Release Notes 11.0 posted at TxDMV.gov for more information on this change. The Motor Vehicle Registration Manual will be updated to reflect these changes in the upcoming January quarterly revision.

Informal Working Drafts and Request for Informal Comments on Rules Relating to Implementation of Senate Bill 15

The Texas Department of Motor Vehicles has prepared informal working drafts of amendments to its rules to implement Senate Bill 15 from the 2021 regular legislative session, the Texas Consumer Privacy Act Phase I.

TxDMV is seeking comments from the public on the informal working draft, and specifically invites feedback on the questions below.

This informal posting of the drafts is intended to gather comments prior to any formal publication of proposed rules in the Texas Register.  The drafts, and the instructions on how to provide comments about them, can be read at https://www.txdmv.gov/general-counsel.   The informal comment period is open until January 17.

TxDMV requests comments on the following questions:

1.       Do the requirements under informal working draft Section 217.123(c) for law enforcement to provide current law enforcement credentials, electronic verification, or a written statement from a supervising officer on letterhead make it easier to receive personal information for criminal investigations than the existing rule that is limited to providing current law enforcement credentials?

2.       Does the requirement to enter into an in-bulk contract with the department for any request over 250 individual motor vehicle records or for information the requestor intends to redisclose for compensation provide enough clarity to those persons that will be required to enter into a contract prior to receiving any personal information? In other words, is it clear that any requests that result in the disclosure of 250 or more motor vehicle records containing personal information will be required to enter into an in-bulk contract prior to the release of records?

3.       Does the informal working draft of Section 217.1231 clearly establish the required documentation that must be submitted to the department prior to entering into an in-bulk contract?

4.       The department is considering ways to enter into in-bulk contracts required by Transportation Code Section 730.014.  As a requestor, are there any special circumstances the department should consider in developing the in-bulk contract requirements under the statute?

5.       Are there any additional comments or points of clarification that the rule should address?

Establishing Motor Vehicle Value for Bonded Titles

As you are aware, the Texas Department of Motor Vehicles (TxDMV) Regional Service Centers establish the value of a motor vehicle for bonded title purposes.  This value is multiplied by 1.5.  The result is the value of the bond which must cover the motor vehicle.  For example, a vehicle valued at $10,000, multiplied by 1.5, will establish a bond amount of $15,000.  This information is documented on the Notice of Determination for a Bonded Title or Tax Assessor-Collector Hearing (Form VTR-130-ND). 

In October, TxDMV implemented a procedural change at TxDMV Regional Service Centers on how the value of a motor vehicle is established to align with existing Texas Administrative Code.  Previously, the value of a motor vehicle 25 years or older was established at a default of $4,000, resulting in a bond amount of $6,000.  Upon review of Texas Administrative Code, Section 217.9(c), it was determined the value of all motor vehicles, regardless of age is to be established as follows:

  1. Standard Presumptive Value (SPV) from the TxDMV Internet website.
  2. If the SPV is not available, then a national reference guide will be used.
  3. If the value cannot be determined by either source, then the person may obtain an appraisal.

Only when an appraisal is used (SPV and a national reference guide do not establish a value) does the age of the motor vehicle become relevant.  With an appraisal:

  • If the vehicle is less than 25 years old, the value as established on the appraisal is used.
  • If the vehicle is 25 years or older, and
    • The appraisal is less than $4,000, the value is set at $4,000.
    • The appraisal is $4,000 or more, the value as established on the appraisal is used.

As a reminder, applicants who disagree with the value of a motor vehicle as established by SPV are not able to utilize another means of establishing a value, such as a national reference guide or an appraisal.  Texas Administrative Code makes no such allowances.

This change has no impact to how county tax assessor-collector offices are to process bonded title applications.  Please continue to ensure the applicant presents a bond in the amount as established on the Form VTR-130-ND.

Additionally, we would like to bring awareness to two items around establishing the value of a motor vehicle to ensure customers are served as efficiently as possible when directed by your office to pursue the bonded title process: 

  1. The value of most trailers, especially assembled trailers, and aftermarket/assembled vehicles cannot be established through SPV or national reference guides. 
  2. Transportation Code, Section 501.032, requires a Law Enforcement Identification Number Inspection (VTR-68-A) for any motor vehicle which has no previous Texas record.

Advising customers to obtain an appraisal or VTR-68-A, as applicable, will aid the customer by ensuring they have the required documents on their first visit to a TxDMV Regional Service Center.

Good afternoon,

The vendor issue impacting the webDealer system has been resolved and the system has been
restored to full functionality.

We apologize for the inconvenience and any impact on you or your customers.

Please remember that if you used an Internet Down tag, you must enter the information for that
tag into webDEALER as soon as the system is accessible. Doing this will ensure you always have the
full allocation of unused Internet Down tags available when you need them. Also remember that
unused Internet Down tags are valid for one year from the date they are printed.

The webDEALER system is currently experiencing intermittent performance issues due to a vendor outage.  Support staff are working to resolve the issues.   We will provide updates as we work on the issues and when the issues are resolved.

As a reminder, if you are unable to print buyer’s tags, you should use your pre-printed Internet Down tags. Every dealer is allowed a minimum of 30 Internet Down tags. Please remember that after using an Internet Down tag, you must enter the information for that tag into webDEALER as soon as the system is accessible.  Doing this, will ensure you always have the full allocation of unused Internet Down tags available when you need them. Internet Down tags are valid for one year from the date they are printed.

Informational: Systems slowness issues – Tips & Recommendations (12/14/2021 2:30 PM)

Good afternoon,

 

TxDMV staff continue to troubleshoot the issues reported by county offices observing symptoms of slowness and intermittent delays while processing certain transactions, e.g. Title Transfer transactions in RTS. As support staff continue to address reports of intermittent performance issues, TxDMV recommends counties take the following steps to help mitigate these issues.

 

When using the RTS Point of Sale system, all users should minimize the number of applications and windows open at the same time to only those required to process the transactions. We have observed cases where this has had impact on performance for some county users. Additionally, when an employee leaves the RTS Point of Sale system, please ensure they log out completely. For shared workstations, having multiple users logged in at the same time has caused performance issues and degradation of services.

 

These important steps will free up workstation resources (e.g. memory, processor, etc.) ensuring the computer is at full capacity to perform your RTS transactions. This will help to alleviate some instances of systems slowness which have been reported.
