webDEALER Statewide Adoption – Additional Information

As you are aware, Senate Bill 604, enacted by the 86th Legislature, amended Transportation Code, Section 520.005 by adding Subsection (e). This new subsection requires each county tax assessor-collector to make webDEALER available to any licensed motor vehicle dealers (“dealers”) requesting access effective September 1, 2020.

On April 20, 2020, the department announced that to assist county tax assessor-collectors and dealers with initial webDEALER setup, the department had posted “Getting Started with webDEALER” videos at www.TxDMV.gov and additional videos would be released in the near future.

We are now pleased to announce the “Using webDEALER” videos are available to county tax assessor-collector offices and dealers.  The “Getting Started with webDEALER” and “Using webDEALER” videos are available at www.TxDMV.gov:

  • The county tax assessor-collector version is available on the TAC Hub under the “Webinars &  Presentations” tab or https://www.txdmv.gov/tax-assessor-collectors?tab=webinarspresentations. 
  • The dealer version is available on the Dealers portal under the “webDEALER” tab or https://www.txdmv.gov/dealers?tab=webdealer.  

County tax assessor-collector’s offices receiving inquiries from dealers requesting webDEALER access may utilize the dealer versions of these videos as a resource.

The department’s 16 Regional Service Center Managers will reach out to each county tax assessor-collector’s office not currently utilizing webDEALER to schedule time to present “Getting Started with webDEALER” and “Using webDEALER” on a more personalized level and to facilitate questions and answers.

While the requirement to provide webDEALER access to dealers who make a request is not effective until September 1, 2020, there is no prohibition against granting authorization prior to this date. The department encourages you to begin utilizing webDEALER as soon as you are ready.

Important Information Regarding Title Disputes

As we head into June, the Texas Department of Motor Vehicles (TxDMV) wants to remind you it is instituting changes to the handling of title disputes to better align with current statutory requirements and protect the rights of titleholders in Texas.  The department should not be named as a party to lawsuits to establish ownership between private parties because it is not a proper or necessary party to such a suit.

The Texas Legislature has established exclusive options for a party who disagrees with a department action or cannot obtain a title because of lack of evidence. A court order directing the department to issue a title or cancel a title is not within those options and cannot be used to circumvent statutory requirements or remedies.  The exclusive remedies provided by the legislature are described below:

TAC Hearing:

Texas Transportation Code §501.052 allows an interested person aggrieved by the department’s refusal, rescission, cancellation, suspension, or revocation of a title to request a hearing with the County Tax Assessor Collector in the county in which the person resides.   An applicant aggrieved by the Tax Assessor Collector (TAC) decision is authorized to appeal that decision in the county or district court. 

 

Bonded Title:

Texas Transportation Code §501.053 allows persons to obtain a title by filing a bond with the department if the vehicle is in the possession of the applicant and there is no security interest on the vehicle; any lien on the vehicle is at least 10 years old; or the person provides a release of all liens with a bond. Bonded titles provide applicants a means of obtaining a title when they are lacking documentation or evidence that is otherwise required by the Transportation Code and department rule, because the required bond provides a safety net for anyone damaged by the issuance of a title by allowing them to recover damages through an action against the bond.

 

The Motor Vehicle Title Manual and Salvage Nonrepairable Manual were updated and released on April 30, 2020. These manuals can be found on TxDMV’s website at https://www.txdmv.gov/publications-tac/doc_download/3080-motor-vehicle-title-manual and https://www.txdmv.gov/publications-tac/doc_download/3448-salvage-nonrepairable-manual.

As of June 1, 2020, the TxDMV will actively oppose any cases that attempt to direct state action or do not conform to the law.  Any lawsuit brought against the department, other than an appeal of a TAC hearing under Texas Transportation Code §501.052(e), may be subject to dismissal on grounds on sovereign immunity. TxDMV recognizes there will be times when a lawsuit between private parties and court order are needed to provide evidence of ownership when a title is missing.

Follow-up Regarding Issues Identified with County Closure Transactions

This is a follow-up to the communication sent on May 15, 2020, regarding issues identified with county closure transactions. 

On April 20, 2020, the Registration and Title System (RTS) Release 9.6.1 introduced the County Closure checkbox to allow a county tax office to process transactions on behalf of a closed county tax office.  Shortly after implementation, the department identified an issue with the batch process for certain transactions with the County Closure checkbox selected where RTS was not properly distributing fees to the processing and closed counties.  A fix was implemented the evening of May 12, 2020, to resolve distribution of fees.

The department is currently reviewing each transaction processed prior to May 12, 2020, to determine if it was impacted by the batch processing issue and will assist in reconciling reports to ensure the correct funds are attributed to the appropriate county.  The department will work with those counties once we know the overall impact.  In the meantime, counties should continue to remit the total amount shown on page 2 of the COGNOS Funds Remittance Report.  Information will continue to be provided as reconciliation efforts begin.

In addition, the department is aware of an issue with the COGNOS Funds Remittance Report where the fee details are not being reflected correctly.  While the fee details may not be correct, the total amounts reflected on page 2 of the COGNOS Funds Remittance Report are correct.  Programming to resolve the detail information on the report is underway and we will keep you updated on the resolution as the programming is completed.

Two Revised eLearning Modules

As you are aware, Senate Bill 604, enacted by the 86th Legislature, added Transportation Code, Section 520.023. The legislation requires the department to implement a training program on the department’s automated registration and titling system and identification of fraudulent activity related to vehicle registration and titling.

As previously communicated, if new modules are added or existing modules are substantively updated between December 16, 2019, and August 31, 2020, Registration and Title System (RTS) users with permissions requiring these modules will have until August 31, 2020, to complete the module and report completion to the department.  If the completion is reported to the department by August 31, 2020, the associated security permission(s) will not be disabled.  However, if the department is unable to verify completion after August 31, 2020, the permission will be disabled until the module is completed and verified.

Substantive revisions to the following modules will be available on June 1:

       • T-203 Off Road Type Vehicles
       • T-204 Bonded Titles

All RTS users with permissions requiring these modules will have until August 31, 2020, to take these revised modules.  For users who have already completed the modules, RTS will automatically reset their RTS record for these two modules to reflect they are expiring on September 1, 2020.  RTS users who have already taken these modules will need to retake the revised versions and report completion to the department through RTS.

Temporary waiver of vehicle title and registration requirements remains in effect

(AUSTIN, Texas – May 28, 2020) The Texas Department of Motor Vehicles (TxDMV) will reopen its Pharr Regional Service Center on Friday, May 29, 2020, with new office health and safety procedures in place.

The temporary waiver of vehicle title and registration requirements remains in effect. TxDMV will provide a notification when normal services have resumed, allowing the public 60 days from then to conduct any overdue title and registration transactions.

“Texans deserve a safe and convenient option to get the services they need,” said TxDMV Executive Director Whitney Brewster. “The health and safety of our customers, employees and communities were the foundation of this plan to reopen.”

The Pharr Regional Service Center, located at 600 West Expressway 83, will provide the following in-person services by appointment only:

  • Replacement titles.
  • Bonded title notices of determination.
  • Title histories.
  • Temporary permits.
  • Assigned/reassigned numbers.
  • Registration refund authorizations.
  • Investigation and resolution of Texas title errors.

International Registration Plan (IRP) transactions, NAFTA permits, or transactions from motor vehicle dealers and title service companies/runners will only be accepted by drop-off, phone, mail, email, fax, and online.

New office health and safety procedures:

  • All in-person services are available by same-day or next-day appointment only.
  • Offices will be limited to 25% of total capacity.
  • Appointments are scheduled in 15-minute increments, with the first appointment at 8 a.m. and the last appointment at 4:30 p.m.
  • Customer seating will be limited. Customers are encouraged to wait outside or in their vehicle until their designated appointment time.
  • Only one person is allowed in the office per appointment unless a caregiver is needed.
  • Social distancing and hygiene practices will be observed.
  • Service counters will have Plexiglas safety barriers.
  • Daily cleaning and disinfecting will take place.
  • Water fountains will not be available.

As noted in the release, in-person RSC services are available to the general public by appointment only.

International Registration Plan (IRP) transactions, NAFTA permits, or transactions from motor vehicle dealers and title service companies/runners will only be accepted by drop-off, phone, mail, email, fax, and online until further notice.

The operating waivers issued by Governor Abbott in March remain in effect.

TxDMV Holiday Hours – Memorial Day 2020

COVID-19 Closures: As of Friday, May 22, 2020, TxDMV offices remain closed to the public for in-person transactions. For updates on office closures, please visit www.txdmv.gov/covid-19.

Vehicle title and registration services: Registration renewal is available online 24/7 at www.TxDMV.gov. Most vehicle title and registration services are provided by your county tax office. County tax office hours and services may vary. 

Oversize/Overweight permits: Motor Carrier Oversize/Overweight permits can be ordered online 24/7 through the Texas Permitting and Routing Optimization System (TxPROS) at www.TxDMV.gov.
