Become Effective December 31, 2018

 

Important changes are coming soon for Certified Copies of Titles (CCOs) in Texas. Beginning December 31, 2018, all CCOs will have a new document number and issue date, and the Registration and Title System (RTS) will be updated immediately with this information. 

Any CCO issued on or after December 31, 2018, will supersede any prior Texas title or CCO issued and will be the only acceptable Texas title to transfer ownership. 

Original Texas titles and CCOs issued prior to December 31, 2018, will remain valid until a new Texas title or CCO is issued.

The Texas Department of Motor Vehicles (TxDMV) recommends ensuring you have the most recent and valid ownership document by obtaining a complete title history report on the vehicle. Visit TxDMV’s Title Check program at www.txdmv.gov for an approved provider list.

Electronic Display of Apportioned Cab Cards Allowed Starting January 1, 2019

Motor Carriers can display Apportioned Registration Cab Cards on an electronic device, such as a phone or tablet, starting January 1, 2019.

The Texas Department of Motor Vehicles adopted a rule in December allowing International Registration Plan (IRP) registrants to display an electronic image of cab cards. Previously carriers were required to show a paper original or paper copy of a cab card. Cab cards must be shown to law enforcement upon request.

The rule takes effect on January 1, 2019. However, TxDMV recommends that carriers continue to carry a printed copy of cab cards for 2019 to avoid any confusion with on-the-road law enforcement who may not be aware of the change.

Existing rules already allowed carriers to display their Operating Authority (insurance) Cab Cards on electronic devices. Now both forms of cab cards can be displayed electronically.

Texas Permitting and Routing Optimization System (TxPROS) Upgrades on December 11, 2018

The Texas Department of Motor Vehicles (TxDMV) will upgrade the Texas Permitting and Routing System (TxPROS) December 11 to improve the overall customer experience by adding several features and increasing the self-issue limit. 

New Self-Issue Weight

Customers can self-issue certain permit types within TxPROS when the overall size and weight of the vehicle and load are within allowed self-issue tolerances. Effective December 11, the self-issue weight limit in TxPROS will increase from the current 199,999 to 254,300 pounds. Overall self-issue dimensions will be:

  • 20 feet wide
  • 18 feet, 11 inches high
  • 125 feet long
  • 254,300 pounds gross weight

In addition, mileage permits for cranes and well servicing units that fall within the dimensions above can be self-issued.

Weight Certification Requirement

TxPROS customers can now upload required weight certification documents for vehicles/loads that exceed 200,000 pounds gross weight. A permit application missing the weight certification will be held until documentation is received.

Annual Permit Batch Ordering

Customers can again batch order the following permit types:

  • Annual Envelope (AEV) Company Specific
  • Over Axle/Over Gross Weight Tolerance
  • Ready-Mixed Concrete Truck
  • Timber
  • Intermodal Shipping Container Port, and
  • Fluid Milk

For AEV Company Specific Permits, TxPROS will now allow customers to enter the number of permits wanted.

TxPROS will still require that customers attest to the accuracy of each permit prior to mailing. If batching multiple permits, the customer must attest to the accuracy of each permit in the batch or submit a message to the Permit Office indicating there is an issue with a permit. If this step is not completed, the permit will not be mailed. The company will receive notifications from TxPROS that this step has not been completed.

Annual Permit Renewal Notices

TxPROS will automatically generate renewal notices via email and/or mail for annual permits. Notices will be sent at the beginning of each month for any permits due to expire within the following 45 days.

All customers will be prompted to provide a mailing address and email address for renewal notices the first time they order an annual permit after this upgrade release.

Duplicate Permit Prevention

TxPROS will now detect when a duplicate time-based permit is ordered. TxPROS will not issue a permit if it identifies a permit of the same type for the same vehicle for the same date range or overlapping dates. If the customer is aware of the duplication and still wants the permit, they will be required to submit the reason to the Permit Office for review. If the reason is acceptable, a supervisor will override the duplicate stop.

Automated Clearing House (ACH) Payments

TxDMV will now accept payments by Automated Clearing House (ACH), also known as electronic checks. No percentage or fee is charged for payments by ACH. ACH payments will not be accepted for escrow deposits in TxPROS.

 

Length Combination Evaluation

TxPROS will now evaluate axle spacings to determine if a Super Heavy Permit is required. A vehicle combination that exceeds 200,000 pounds and has less than 95 feet of total axle spacing requires a Super Heavy Permit.

The Texas Department of Motor Vehicles (TxDMV) is working to clarify policy on the collection of the 20% delinquent penalty which a customer must pay when they have been arrested or cited for operating a vehicle without valid registration.

Currently, Transportation Code §502.045 and Title 43 of the Administrative Code §217.28 allow for the collection of the 20% penalty at the time of registration renewal. We are aware customers are returning after renewal to pay the penalty when ordered by the court.

Future enhancements to the Registration and Title System (RTS) will be made to accommodate the collection of the penalty after time of renewal. Until this can be accomplished, counties will need to do the following workaround to collect the penalty after registration has been renewed:

• Collect the 20% penalty in “Additional Collections”
• Modify the registration expiration MONTH (if applicable)
• Issue a $6.50 replacement sticker

When a customer is sent back to the county by a court, counties should continue to collect the 20% penalty in “Additional Collections” under “Late Registration Penalty (REGPEN).” In instances where the customer’s registration expiration MONTH started over due to a valid reason being provided at time of late renewal, modification of the expiration back to the original MONTH and printing a replacement registration sticker is required.

In RTS, the county must select “Modify,” “Registration Correction” and adjust the MONTH as applicable to change the expiration back to the original MONTH. The county must require the customer to return the previously issued sticker before issuing a replacement registration sticker. The replacement fee must be collected in this instance. Counties should process all three events in one transaction using the “More Trans” functionality.

Please note: RTS currently cannot accommodate situations where modification of the expiration YEAR is required (This will also be addressed in the future enhancement of RTS). In this instance, counties should only collect the 20% penalty. Furthermore, counties should not collect additional MONTHS of registration fees to reconcile back to the original expiration.

TxDMV Holiday Hours – Thanksgiving

In observance of Thanksgiving, the Texas Department of Motor Vehicles (TxDMV) will be closed on Thursday, November 22, and Friday, November 23. Additionally, the Oversize/Overweight Permits Office will be closed on Saturday, November 24.

Vehicle Transfer Notifications Become More Important December 31, 2018

 

Texas dealers, take note to protect yourselves from title fraud: On January 1, 2019, a new law related to Certified Copies of Title (CCOs) will take effect.  Senate Bill 2076 passed by the 85th Legislature amended Transportation Code, Section 501.134(d), to provide that a lawfully obtained CCO supersedes and invalidates any previously issued title or certified copy.

This change will become effective in the Texas Department of Motor Vehicles system at the start of business on December 31, 2018.

The goal of this new provision is to ensure that once a CCO is issued, it becomes the only valid proof of ownership. Prior to the passage of this law, Texas was the only state to allow the original title and any CCOs to all be valid evidence of ownership simultaneously, which often led to confusion for motorists and lending institutions, and was an opportunity for fraud.

Texas dealers who take vehicles in on trade should be particularly aware of this change.  Dealers should always submit a Vehicle Transfer Notification (VTN) right away to protect themselves from someone fraudulently obtaining a CCO after trade-in.  This will become even more important beginning on December 31, 2018.  

Completing and submitting a VTN is quick and easy.  You can electronically submit a VTN via eTAG.  From the eTAG Home Page, click on the “Tags” tab and select “Vehicle Transfer Notification” from the drop-down menu.

One of the pillars of the Texas Department of Motor Vehicles mission is to “protect…the citizens and industries in the state with quality motor vehicle related services.” The department is confident that this new approach to CCOs will help us meet that mission, but we can’t do it without you. We encourage all dealers to adopt a habit of promptly submitting VTNs and, as always, we appreciate your partnership.

Texas Department of Criminal Justice Lockdown

As of November 5, 2018, the Wynne Unit in Huntsville is under lockdown status. This is a routine lockdown. At this time, the Texas Department of Criminal Justice (TDCJ) anticipates being in this status through the end of this week and probably next week. No special plate orders will be filled or shipped until the lockdown is over. Small emergency orders received through allocations will be filled. Emergency orders consist of warehouse items (non-special plates) that will sustain a county or region that is near depletion for a few days. These orders must be kept to a minimum as they will be shipped FedEx.

An update to the lockdown status will be provided as information is received from TDCJ.

TxDMV Help Desk Changes – November 1, 2018

Effective Thursday, Nov. 1, 2018, tax assessor-collector staff will have a new TxDMV Help Desk number to call for technology, funds adjustment, billing or accounts receivable issues. You will be able to reach a live support person faster, without navigating through a menu of options, by calling this dedicated county-only hotline: 512-465-3351.

TxDMV is also enhancing support by moving Help Desk staff into our Consumer Relations Division (CRD), so there will be a greater number of employees trained and available to take calls from county tax offices.

You should continue to contact your TxDMV Regional Service Center (RSC) for issues not related to technology, funds adjustment, billing or accounts receivable.

Motor Vehicle Dealer Training Seminar – Corpus Christi

Motor Vehicle Dealers and Industry:

We are pleased to announce our Motor Vehicle Dealer Training Seminar on November 15th, 2018, in Corpus Christi, Texas.  This presentation will be a broad overview of the rules and regulations surrounding the motor vehicle dealer industry.

Representatives from our Enforcement and VTR divisions will provide valuable information on dealer operations and titling requirements.  We will also have a representative from the Texas Office of Consumer Credit Commissioner who will provide instruction on financing options for dealers.
