Revised Application for Texas Title and/or Registration (Form 130-U) and Detailed Instructions for Application for Texas Title and/or Registration (Form VTR-130-UIF)

The Application for Texas Title and/or Registration (Form 130-U) has been revised as a result of Senate Bill 976, enacted by the 86th Legislature, to allow an applicant to indicate they have a communication impediment. Additionally, minor changes were made for consistency throughout the form. Due to these changes, the Detailed Instructions for Application for Texas Title and/or Registration (Form VTR-130-UIF) has also been revised.

The revised Form 130-U and Form VTR-130-UIF are available on our website at www.TxDMV.gov and may be used immediately.

Existing versions and pre-printed stock of Form 130-U remain valid for use. Once the existing, pre-printed stock is depleted, the revised Form 130-U will be available for order by county tax assessor-collector offices.

Storm-Related Temporary Suspension of Motor Carrier Requirements

Governor Greg Abbott has declared a disaster for certain counties affected by the storm that struck Texas October 20, 2019. The Texas Department of Motor Vehicles has responded by temporarily suspending IRP vehicle registration, 72/144-hour temporary registration permits, size and weight restrictions, and oversize/overweight permitting requirements for vehicles and loads associated with activities needed to provide disaster assistance to those counties.

Included are: Cass, Cameron, Collin, Dallas, Ellis, Erath, Hunt, Kaufman, Lamar, Panola, Rains, Rockwall, Rusk, Tarrant, Van Zandt and Wood counties.

Motor carriers involved in these efforts should print the Governor’s declaration and the TxDMV Waiver Notice and carry both in the vehicle. Both documents are found here under “Take Note”: http://www.txdmv.gov/motor-carriers

You may use the “Bid Route” feature in the Texas Permitting and Routing Optimization System (TxPROS) at https://txpros.txdmv.gov/ to route loads safely during this emergency. For information on other restrictions go here: http://www.txdmv.gov/motorcarriers/permit-restrictions.

TxDMV publishes rule proposals in the October 18, 2019, issue of the Texas Register.

The Texas Department of Motor Vehicles (TxDMV) has proposed rules in the October 18, 2019, issue of the Texas Register. The proposed language is available on TxDMV’s website at https://www.txdmv.gov/general-counsel/proposed-and-adopted-rules.

The proposals are posted for public comment until 5:00 p.m. on November 18, 2019. Please submit separate comments for each proposal.

The proposals include:

  • new §§217.76-217.78 concerning suspension or denial of access to the Registration and Title System; and
  • new Chapter 223 concerning county tax assessor-collector reporting of suspected fraud, waste, or abuse.

October 2019 Motor Vehicle Title Manual Update

The latest update to the Motor Vehicle Title Manual (attached) is now available via Registration and Title System workstations and at www.txdmv.gov.

We welcome your feedback and encourage you to email any comments or suggestions to VTR_Title_Reg-Manual-Update@txdmv.gov (please note the underscores between VTR and Title and between Title and Reg).

Updates for this release are marked with red change bars in the text.

A majority of the manual revisions include changes from the 86th Legislative Session. The following are brief summaries of the chapters updated in the October 2019 revision.

Chapter 6 – Application and Issuance of Certificate of Title
Section 6.1, “Application for Texas Title and/or Registration (Form 130-U),” was updated as a result of Senate Bill (SB) 976 to add information regarding the ability to add or remove a Communication Impediment indicator to a vehicle record. The Certification of a Communication Impediment (Form VTR-216) was created to facilitate the implementation of this bill.

Section 6.10, “Stop Title Requests,” was updated to provide clarifying language on the requirements for when a temporary legal hold is placed on a motor vehicle record.

Chapter 10 – Evidence of Ownership
Section 10.2, “Manufacturer’s Certificate of Origin (MCO),” was updated as a result of House Bill (HB) 1548 and HB 1755 to clarify an MCO for an off-highway motorcycle, all-terrain vehicle (ATV), recreational off-highway vehicle (ROV), utility vehicle (UTV), and sand rail must contain a statement the vehicle is for off-highway use only.

Chapter 13 – Evidence of Ownership
All of Chapter 13 was updated as a result of HB 3171, to remove the term “motor-driven cycle” and replace it with “motorcycle.” Additionally, updates were made as a result of HB 1548 and HB 1755 to add UTVs and sand rails to the list of off-highway vehicles throughout the chapter.

Chapter 14 – Vehicle Types
Section 14.1, “Definitions,” was updated as a result of HB 1548, HB 1755, and HB 3171 to update the definition of a motor vehicle to include an off-highway vehicle and to remove the reference to a motor-driven cycle.

Section 14.3, “Moped,” was updated as a result of HB 3171 to update the definition of a moped.

Section 14.13, “Off-Highway Use Vehicles,” was updated as a result of HB 1548 and HB 1755 to incorporate information provided in the Registration and Title Bulletin (RTB) #004-19, which details the titling requirements for UTVs and sand rails.

Section 14.14, “Miscellaneous Vehicle Types,” was updated as a result of HB 1755, to update the former military vehicle definition.

All of Chapter 14 was updated as a result of HB 3171, to remove the term “motor-driven cycle” and replace it with “motorcycle.” Additionally, information was updated to add UTVs and sand rails to the list of off-highway vehicles throughout the chapter.

Chapter 17 – Rights of Survivorship
Section 17.1, “Rights of Survivorship Agreement,” was updated to provide clarification that a death certificate is required to be presented with a transaction in which it is needed as supporting documentation; however, it should be returned to the applicant.

TxDMV publishes 5 rule proposals in the August 30, 2019, issue of the Texas Register

The Texas Department of Motor Vehicles (TxDMV) has proposed rules to 43 TAC Ch. 217 in the August 30, 2019, issue of the Texas Register. The proposed language is available on TxDMV’s website at https://www.txdmv.gov/general-counsel/proposed-and-adopted-rules.

These proposals are posted for public comment until 5:00 p.m. on September 30, 2019. Please submit separate comments for each proposal.

 

The proposals address:

             

              (1) amendments to §217.2 and §217.45 concerning specialty license plates, symbols, tabs, and other devices; and §217.46 concerning commercial vehicle registration;

 

              (2) new §217.15 to establish a process for the TxDMV to issue a title to a government agency for a travel trailer used by the government agency to provide temporary housing in response to a natural disaster or other declared emergency;

 

              (3) new §217.16 concerning an application for title when dealer goes out of business, and amendments to §217.40 concerning special registrations;

 

              (4) amendments to §217.27, concerning extended registration of a trailer, semitrailer, or pole trailer; and

 

              (5) amendments to §217.41 concerning the location at which an application for a disabled parking placard may be made.

RTS 9.4.0 Fix for the Issuance of Temporary Permits

Registration and Title System (RTS) Release 9.4.0 added new hard stops for timed permits (72-Hour, 144-Hour, 30-Day, and One Trip) that required an authorization code to complete the transaction in RTS Point-of-Sale (POS). While the hard stops were intended to prevent fraudulent use of all timed permits for a vehicle not otherwise eligible for a permit, certain hard stops incorrectly required an authorization code to issue the permit.

A fix to the RTS POS was deployed after close of business on September 4, 2019, to correct this issue. The fix restored your ability to issue timed permits without obtaining an authorization code when the vehicle record reflects one of the following remarks:

  • Title Only and REGISTRATION INVALID
  • AWAITING NMVTIS VIN INQUIRY
  • TITLE HELD APPLICATIONS AWAITING RELEASE
  • TITLE HELD AWAITING DPS OK
  • TITLE REJECTED
  • TITLE REVOKED
