Motorcycle Dealerships Notification

ATTENTION ALL MOTORCYCLE DEALERSHIPS

It has come to our attention that not all motorcycle dealerships in Texas are including destination (freight) charges and dealer prep fees (handling) in the advertised sales price of motorcycles on their websites.

According to Texas Administrative Code, Title 43, Part 10, Chapter 215, Subchapter H, Rule § 215.250(a):

When featuring a sales price of a new or used motor vehicle in an advertisement, the dealer must be willing to sell the motor vehicle for that featured sales price to any retail buyer. The featured sales price shall be the price before the addition or subtraction of any other negotiated items. Destination and dealer preparation charges must be included in the featured sales price.

Other fees that can be excluded from the sale price are tax, title, license, and other fees or charges that are allowed or prescribed by law.

Please update your websites to reflect a correct disclaimer and ensure that the destination and dealer prep fees are included in the featured sale price for each motorcycle.

You may call the TXDMV Enforcement Division at 512-465-4205 if you have any questions.

Thank you for your cooperation.
